Backers of Prop. 8 don’t want Jerry Brown listed as on their side in federal challenge to same-sex marriage ban


A judge is expected to rule tomorrow on a motion by backers of Proposition 8 seeking dismissal of a federal lawsuit brought against it by supporters of same-sex marriage. And, even though California Attorney General Jerry Brown is named as a defendant in the suit, he has sided with opponents of the proposition and says the challenge should move forward.

The lawsuit, Perry vs. Schwarzenegger et al, is being heard in U.S. District Court for Northern California in San Francisco and names Brown and other state officials, including the governor, as defendants. Chief U.S. District Judge Vaughn Walker has scheduled a hearing tomorrow to rule on a motion for summary judgment filed by Prop. 8 supporters, who argue the judge should dismiss the suit before it goes to trial because the plaintiffs lack sufficient legal grounds to strike down the voter-enacted ban on same-sex marriages in California.

But in papers filed with the court on Sept. 23, Brown says “the Attorney General has conceded the material facts in the plaintiffs’ complaints” and that he “agrees with the plaintiffs that Proposition 8 violates the 14th Amendment.” Lawyers for Gov. Schwarzenegger and other state officials named as defendants filed papers saying they “neither support nor oppose” the motion to dismiss.

As a result of Brown’s refusal to defend Proposition 8 as the state’s attorney general, supporters of the measure filed an unusual motion on Oct. 2 asking Judge Walker to remove the attorney general as a defendant in the case and instead include him as a named plaintiff.

"As matters now stand, plaintiffs have a party on the other side of this dispute who shares their ultimate goal of invalidating Proposition 8," said attorneys defending Proposition 8 in filings with the court. "Plaintiffs might well turn the old adage on its head and ask: With enemies such as these, who needs friends?"

According to an Oct. 5 story about the case, the San Jose Mercury News noted, “In numerous legal briefs, Brown has sided with the plaintiffs' central legal argument that Proposition 8 violates the equal protection rights of same-sex couples seeking the right to marry. It is a rare example of the state's top lawyer declining to defend a California law in the courts.”

Because of Brown’s unwillingness to defend Prop. 8, and the Schwarzenegger Administration’s ‘neutral’ position on the lawsuit, Judge Walker has allowed lawyers for the Yes on 8 campaign to intervene in the case in defense of the measure.

When same-sex marriage backers unsuccessfully challenged Prop. 8 before the California Supreme Court, Brown also sided with those urging the state’s highest court to invalidate the voter-approved constitutional amendment. California justices ultimately ruled 6-1 that Proposition 8 was a valid amendment to the state constitution.

After losing their case before the California Supreme Court, opponents of the proposition turned to the federal courts in their efforts to invalidate the prohibition on same-sex marriages, arguing it violates equal protection guarantees of the U.S. constitution. Should Judge Walker reject the motion for summary judgment tomorrow, the case is scheduled to go to trial in January 2010.

Just as legal remedies to counter abortion litigation won't succeed until we change the hearts of the people: We have no hope of overcoming these relentless assaults on marriage and family until we take two specific steps: 1) Explain to the majority of people why defense of marriage and family is the compassionate thing; but first 2) become thoroughly and explicitly educated in the facts of the situation ourselves - we can't explain what we don't thoroughly understand, one can't give what one doesn't have. The best resource for becoming educated is "One Man, One Woman: A Catholic's Guide to Defending Marriage" by Dale O'Leary. Unless we accomplish these 2 things, the homosexualist assault on the stable foundations of society will ultimately succeed.

You're in absolute denial about the status of the Perry v. Schwarzenegger federal challenge. Walker will not dismiss the trial He was the one who insisted that a factual record be furbished for the SCOTUS review. We're so close to exposing your disgusting religion, and the Catholic corporation's illegal involvement in the passage of prop 8, that repeal my right to get married. I hate you for it, and support future lawsuits aimed at your pathetic religious franchise. It will be a vindicating delight when Walker forces the Yes on 8 bigots to hand over their emails too!

Evil is tireless. Gerry Brown has aligned himself with the wrong side again, which is not news to anyone who has followed his career. This will not end until the United States Supreme Court rules on it.

Hey Flex SF, you summed up whole No on 8 view of life itself with your own word, "hate". All of you are so full of hate! You hate everything that is pure and good. You even hate life itself so much that you push for the slaughter of the most innocent even though you will never procreate because of your lifestyle. I pity you and all like you and I will pray for your conversion. Why? because I love you in the true meaning of the word "Love".

Virgo Potens: Not even potentially are you correct in your understanding of the natural law. The natural law is not "imposed" upon us by God, as it were, externally. The natural law is the law written by God on the human heart. Those persons who are not cognizant of the divine positive law (the ten words of Moses; the ten commandmants; the decalogue) or the evangelical law of Christ nonetheless still, precisely because they are created by God, show in their deeds "that the requirements of the law are written on their hearts, their consciences also bearing witness, and their thoughts now accusing, now even defending them" (Romans 2:15). Such, VP, is the natural law. This law is not something "imposed" on human nature but rather is a constitutive feature of that nature -- a law, as St. Paul says, written on the heart. See J. Budziszewski, _Written on the Heart: The Case for Natural Law_ (1997).

I'm an Asian-American and a faithful Buddhist. Our religion take a neutral stand on homosexuality and is very tolerant of people from all walk of life. The problem I see with Prop 8 is that if majority of Californians can vote to strip away gay people from marrying. It sets a scary precedent where people can vote to strip away rights of other minorities such as the rights to practice Buddhism, the right for Muslim women to wear headscarves, etc. I believe that everyone should have equal rights to practice any religion of their choice. I also believe that gay people should have equal rights to marry. I think some Christians and Catholics who are against gay marriage are getting it all wrong here. Allowing gay people to marry doesn't threaten the institution of marriage. It actually strengthens the institution by promoting monogamy and stability for their families. I find it weird that Prop 8 backers can cite causal relations between gay marrying and the destruction of human society. Heterosexuals will continue to exist, marry and produce children, just like homosexuals will continue to exist, marry and adopt children that need loving home or have children of their own through surrogates. We should be mature enough to move on from this issue and instead focus on strengthening marriage by reducing domestic violence, infidelity and sharing responsibilities in raising children.

wit---You state in you post that you are a faithful Buddhist,and that your religion takes a neutral stand on homosexuality. I have no problem with any of that as it pertains to you and your religion. However,the church to which I belong does not take a neutral stand on homosexuality, the practice of which it regards as sinful,as forbidden by our Lord and Master. I do have a problem with my own church because there are those within it who have attempted,with remarkable success,to infiltrate our church and convert our beliefs into those of your religion,a position I find untenable,morally or spiritually. Respectfully,may I suggest that you proselytize into your religion, those who confess homosexual activity yet claim to be members of my church. That way they can be "comfortable" in your religion,and and I can be more comfortable in mine. For those of us who remain faithful to our religion, we will have have lost nothing because those we lost were not members of our religion in the first place. And as Buddhists,you ,with your newly found homosexual faithful, should feel free to attempt to proselytize those of us who cling to our faith. You will have an advantage over us because your new adherents will have years of experience trying to convert us to the Buddhist position as you expressed it. Good luck in your endeavours,should these things come to pass. By the way,the highest ranking member of the Church of Rome fervently endorses freedom of religion for all. From Rome,you have nothing to fear!

Tom-- I completely agree that you should be free to take a stand on this issue and criticize people within your church community who want to make any changes. My personal opinion is that the active condemnation of homosexuality can be divisive, especially in a diverse state like CA. I am certainly not looking to proselytize other people into my religion. In fact, a lot of people view my religion as a philosophy. Some Christians practice Buddhism however it fits their life, but still attend their churches. Like I can also learn several things from the bible and use some of its teachings in my life. I just believe religions should not proactively lobby for or against this issue, especially in helping to get it on the ballot, contribute money and influence members to vote for or against it. This is an example of bringing one of the faith beliefs, which is held by a majority, into the public arena and enforce it into a law by a simple vote. I know it's part of a democratic process and everyone is entitled to exercise this right. I just don't believe this whole fight is worthwhile to be brought up in the first place. I just want everyone to move on from this contentious issue and focus on something else that is more urgent like reducing domestic violence, promoting love in the family and encourage voluntarism. There's no reason to stop promoting straight marriage as an ideal foundation for the society, but at least acknowledge the existence of gay unions. I mean technically, there're still 18,000 legally married gay couples in CA. They're not going to disappear. They are our neighbours and friends. They are entitled to be recognized by our state but they may not be recognized by your church, etc. I am happy to have a civil discussion with you and I hope that by reaching out to people who disagree with me on this issue, we can at least agree to give legal rights for gay to marry, but also retain the rights for the churches to accept it in their own settings.

Here we go again with the liberal nonsense making everything a "right" that is NOT! The reality is that they are mixing a sacrament with a civil issue. If it was purely "legal", they are free to sin in any way they see fit! However, when a sacrament is involved, it is NO LONGER A "RIGHT"! God defines what is acceptable in the realm of sacraments, NOT man! Sorry, but God is very clear as to the sacrament of Matrimony! I had the dubious honor of winning an award in high school to spend a week with Governor "moon beam" in 1975. It was one of the more bizarre experiences of my life. He was obviously "out-of-it" most of the time! Jesse was running the place! Brown was totally out of touch with the issues and was a puppet on a string! ALL of his decisions were predicated on the polls and the input of his party! He ignored the input from his constituents, which really upset me. I tried to discuss this with him, and he basically told me that politics was about survival; NOT doing what was right! As class valedictorian and a member of mentally gifted minors, the award/program was supposed to stir interest in politics for "high-functioning" students, but my experience soured me on politics forever!
