“Bubble law has backfired”

Imprisoned pro-life pastor gets early jail release for ‘good behavior;’ case has given new energy to anti-abortion movement in Bay Area


The Rev. Walter Hoye, the Berkeley pastor sent to jail for violating Oakland’s abortion clinic ‘bubble ordinance,’ has been released after serving 18 days of his 30-day sentence. A source close to the case told California Catholic Daily that Hoye’s sentence was reduced by 10 days for “good behavior,” plus additional credit by the sentencing judge for the time Hoye spent confined in a patrol car after his arrest.

Hoye walked out of the Santa Rita Jail in Dublin at 12:45 p.m. on Tuesday. One of his last visitors while incarcerated was Oakland Bishop-designate Salvatore Cordileone, who met with Hoye on Saturday at the jail. "He visited Walter Hoye because he respects Hoye's affirmation of the value of human life," diocesan spokesman Mike Brown told the Contra Costa Times.

The Contra Costa newspaper noted that Hoye’s imprisonment had invigorated pro-lifers, reporting the Baptist pastor “went free Tuesday with a wider, louder network of anti-abortion supporters than before he went to trial.”

For years, Hoye had been a pro-life fixture outside Family Planning Specialists Medical Group in Oakland until his arrest and eventual imprisonment. The scene outside the abortion center has changed dramatically since then, said the Times, reporting: “The sidewalk near Jack London Square that Walter Hoye patrolled weekly -- accompanied by two elderly church women -- drew a crowd of a few dozen protesters Tuesday morning for another in a series of vigils aimed at painting the law as an attack on free speech. Now, as Hoye pushes to reverse a judge's order to stay away from the clinic, his backers said the city's year-old ‘bubble law’ -- which bans approaching within 8 feet of a potential client trying to enter a clinic -- has backfired.”

"They would have been in a better position if they would have left him alone,” Dion Evans, pastor of Alameda's Chosen Vessels Christian Church,” told the newspaper. “They picked on one man on one street, one day a week trying to reach one woman at a time with one sign for one hour. Now a mobilization has come together because they've created an unjust law. People like myself who have been cheerleading are not on the sidelines anymore. We're now in the game."

On Friday, March 20, Alameda Superior Court Judge Stuart Hing sentenced Hoye to 30 days in jail and fined him $1,130 for violating Oakland’s ‘bubble law,’ which was crafted specifically to keep pro-life sidewalk counselors away from women entering abortion centers.

Hoye had initially been charged with four counts of violating the ordinance – two counts of “unlawful approach” and two counts of using “force, threat of force or physical obstruction” against ‘escorts’ at the clinic. The charges stemmed from two separate incidents – one on April 29, 2008 and one on May 13, 2008. Hoye was arrested on May 13 after a clinic staff member called police. He was carrying a 40-inch sign that read, "Jesus Loves You & Your Baby. Let Us Help You," and attempting to hand out pro-life literature.

What a man, and good for Bishop Cordileone for visiting Hoye in prison. Oakland's law, like all evil laws, will die, as will the abortion rights movement, once the light of truth hits. The initial need is for someone of courage to take the initial punishment. And Rev. Hoye is that man.

I've heard pro-abortion "clinic" escorts attempt to reinforce their unhappiness at their radical sexual-lifestyle choices by claiming that pro-lifers are "rich". Anyone who doesn't now know that it is the radicals who are now "the Establishment", has holes in, doesn't have screwed on, and needs his head examined.

Freedom! Wonderful news. Now let us free the Americans not yet born from the murderous clutches of abortionists. I do not understand people who support the concept of parents having the right to kill their children, as long as they are so young they are not yet born. Do they also support the concept of children having the right to kill their parents who are not yet dead? Why is it ok for parents to kill their children as long as they are not yet born or viable outside the womb? And since viability is not determinable with certainty, it is a vague concept and should be thrown out as legally indeterminable. Let us join Rev. Hoye in front of the abortion centers, and let us send him money to pay his bills.

Our joy over the release of Walter Hoye from unjust incarceration is doubled over the announcement of the visit to Walter by incoming Oakland Diocese Bishop Salvatore Cordileone. Perhaps now we pro lifers will get some consideration in this diocese.

I also pray especially today for another hero, our great Catholic knight Randall Terry, as he confronts the grotesque evil inhabiting the administration of a notable formerly Catholic university.

Rick DeLano, you have spoken out in support of both Randall Terry and Rev. Hoye, showing that God is sending you the courage you pray for. I found it hard to discover I would be the lone demonstrator on a day I was expecting to join several others in front of the Planned Parenthood clinic during a 40 Days for Life planned prayer event. I prayed to God for guidance as to what to do, and immediately a calm came over me, and I knew I would have to pray and hold my sign alone for the next 4 hours. Almost all motorists passing by were wonderfully supportive, honked and waved, or smiled and gave me a thumbs up sign. I was buoyed up by so much friendly support, and I was able to smile and wave serenely at the few who were loud and rude, mostly carsful of adolescent boys or college age kids. No one who was alone was rude or even negative; only when the car was full of 2 or usually more was there any rudeness. One car started toward me driving fast, as if to try to run over me, and that scared me briefly until they laughed and steered away, but apart from that, it was one of the most beautiful days of my life. One couple in a car who appeared to be there for an appointment sat for a while in the parking lot, looking at me while talking, and then started the car again and drove away. I don't know for sure that a baby's life was saved that day, but I know that I cried tears of joy. God will give you the courage to do whatever is right whenever you ask, and most times you will be joined by wonderful and caring people. Your courage will be rewarded hundreds of times over, and you will feel more than blessed as you join others to help make this a world safe for babies and goodness.

Oakland, San Diego is in tears over losing Bishop Cordelione, but also in tears of joy because he has proven to be the man that we know him to be, by visiting the Reverend and making himself known to be a strong advocate for family and for life. Your gain is only going to grow bigger. The Bishop will be a true Shepherd to your flock, and God will continue to bless you all. I will continue to pray for him, and the Reverend. Bishop Cordelione is not one to shrink from a good fight like the one we are all waging for the unborn. So, get ready to be lifted up, and joyful, your new Bishop is a real keeper. God Bless the Reverend and his efforts for us all. We all benefit from saving our future citizens, the unborn children who are our hope.

Good for these two great men. Well, they are going to have to deal with Rev. Hoye's mail at the jail for quite awhile because cards and letters are still going to him I am sure.

What injustice! To confine a man of God for a misdemeanor. The case was never proven. There was no victim. Reverend Hoye was simply too effective in persuading women to keep their unborn children. I think the clinic should be required to give him his own office and all clients should have to be counseled by him prior to having their abortion. Perhaps that could begin to undo the damage of the false imprisonment and the robbery of his first amendment rights. How about it?
