Legal groups join forces in defense of San Diego Boy Scouts

ANN ARBOR, MI –
The Thomas More Law Center (TMLC), a national public interest law firm based in Ann Arbor, Michigan, and the Alliance Defense Fund (ADF) joined forces to file a friend of the court brief asking the United States Supreme Court to overturn a decision by the Ninth Circuit Court of Appeals penalizing San Diego Boy Scouts because of their “morally straight” values.

At issue in the case are leases from the City of San Diego allowing the San Diego Boy Scouts to build and operate campgrounds and an aquatic center for use by the Scouts and the public. Lesbian and agnostic couples, who had never visited the facilities, sued the Scouts on a claim that they felt offended by the fact that the City leases the public property to a “morally straight” organization such as the Boy Scouts. There were no religious symbols at the facilities.

Richard Thompson, President and Chief Counsel of the Thomas More Law Center commented, “We are pleased to join forces with ADF in this is important case to protect the Boy Scouts of America. Radical homosexuals are attempting to use every means possible to destroy the Scouts despite a recent U.S. Supreme Court decision that recognized their First Amendment right to have a morally-based policy excluding homosexual involvement.”

According to the Scout Oath, a Boy Scout is “to do duty to God and country… and to keep morally straight.” The lawsuit against the Scouts was brought by a self-proclaimed “agnostic” couple and a lesbian couple.

The initial three-judge panel of the Ninth Circuit that heard the case dismissed the lawsuit, finding that the couples lacked standing to sue because “offended observers” do not have a real injury in fact. That decision was subsequently reviewed by an en banc panel of the Ninth Circuit, which reversed in favor of the agnostic and lesbian couples. The Boy Scouts are asking the Supreme Court to review the decision.

In their friend of the court brief, TMLC and ADF argue that the Ninth Circuit’s permissive standing rule, which is essentially a permissive ideological standing rule since the agnostics and lesbians suing the Scouts never “observed” anything, represents a new threat for faith-based organizations that choose to cooperate with the government in establishing public benefit programs. Litigants in the Ninth Circuit can now challenge programs like San Diego’s with nothing more than general offense at a tenet of an organization’s mission. So long as a person feels unwelcome by the private groups’ beliefs – without any exposure to religious symbols or denial of any services – he can sue to have the program declared unconstitutional.

According to the brief, TMLC and ADF argued that the ideological standing authorized by the Ninth Circuit’s decision would significantly impact faith-based groups’ cooperation with government to provide much needed social services. Consequently, the overarching effect of the Ninth Circuit’s decision is a new type of hostility to religion, where government excludes religious groups from programs simply because officials fear being sued. This new hostility is a significant public detriment because it erodes faith-based groups’ provision of much-needed public services. The brief concluded by noting that the permissive standing rule adopted by the Ninth Circuit combined with the unpredictable Establishment Clause jurisprudence of the Supreme Court forces government to steer away from cooperative efforts with faith-based organizations to the public detriment.

Did it ever occur to the Ninth Circuit that "feeling offended" cuts both ways? Will they respond when Christians feel offended? Of course not, since it's not about feelings at all, but about advancing the new ideological terrorism.

The plan of the homosexual movement marches on. Demand tolerance but never practice it. Marginalize and segregate religion and morality as outside the norm. Normalize homosexuality and make sure that proponents of traditional values are deemed hateful. In Massachusetts, Catholic Charities, who had placed the majority of children in adoptive homes was forced to stop facilitating adoptions because they would not place children with homosexual couples. This was the direct result of allowing homosexual marriage in Mass.

There's a secondary, internal logic to the homosexualists' attack on Scouting: As a lifestyle, Scouting is almost sure inoculation against certain causes underlying Same Sex Attraction (SSA). Here's how it was described by Dr. Philip Mango, President St. Michael's Institute, interviewed on 4/22/09 on "EWTN Live" by Fr. Mitch Pacwa, S.J. (the program is on the EWTN audio library, 2nd search window, the search term "Mango"): In a family situation with a remote father and a smothering mother, she says to the boy, "you don't want to play with those dirty boys, you don't want to go hunting with Uncle Harry, that's bad"; he begins to see masculinity as negative, excessive femininity as affirmative, and tries to identify with femininity. Many SSA-prone boys suffer from a sense of isolation, alienation and differentness. Yet as he grows into adolescence, he still seeks to develop his masculinity in male relationships. In the robust world of Scouting, many an ungainly little boy, even without a father, is able to achieve confident masculine identity. (Incidents of child abusers making use of the Scouting institution as cover for their activities are no greater than in other sectors of our society and do not invalidate the institution.) The homosexualists' attacks are primarily in response to Scouting's child-protection policies; but even when Scouts are officially disenfranchised, the persecution won't stop, because homosexualism is fundamentally in opposition to what Scouting does.

In the past, in this country and elseware, the boy scouts were seen as a clean, virtuous organization that was known for doing good deeds. Scouts were expected to and for the most part lived up to higher standards. Being a scout, or having been a scout was a "Feather in your cap". Former Pres. Gerald Ford was an eagle scout and he was proud of it, and rightly so. Now a days, the scouts are being vilified and attacked by athiests, and militant homosexualsand the media. Instead of being portrayed as honorable, virtuous, moral, and reverent, the scouts are being called mean spirited, hateful, and homophobic. It seems that virtue is out the window, and vice and immorality are now vogue. God help us and God have mercy on this nation!

When someone asks you what harm would it do to create such a thing as legalized homosexual "marriage", point to things like this. They will not stop until all public organizations are radically pro-homosexual. They want to force orphaned kids to be adopted by same-sex couples, even when there is stable normal couple available to adopt. They want homosexuality to be taught in the schools starting in kindergarten. They want to silence all medical evidence of the dangers of homosexuality. And they want most of all to silence the Church.

So why is it that some see the danger while others do not? Why is that some accept what their own eyes see and what their ears hear, but others do not? Let's widen the question and ask why do some people understand the sacrifice of Calgary while to others it is nonsense? Have you ever tried to explain some things about Christianity to a non-believer? Or can you remember how some things about the faith used to be unclear or did not make sense to you in the past? From my own experience, and from what I've heard from some very learned people, this is the power of prayer at work. As St. Paul said, the gospel is "folly to the gentiles." It is only through God's grace that we understand it. I know that a little more than a year ago, I would have been saying things very much like many of the dissenters on here about homosexuality. Somehow, when I wasn't even looking, my heart was changed and I realized that I understood the Church's teaching. Sin ruptures the state of grace, so it is no wonder that a person steeped in the secular culture - whether homosexual or not - is not going to see the truth. From the Old Testament - "the beginning of wisdom is fear of the Lord." Truer words were never spoken. It all has to start with humility and obedience. "Not my will oh Lord, but your will be done." Not "your will oh Lord, except for my homosexuality which I like a lot." Any other sin can just as easily be filled in there. This I suspect is why so many cannot see and will not hear.

I kind of doubt that this will get anywhere at the moment. I am an Eagle Scout, and am proud of the organization's adamant refusal to allow declared homosexuals access to their young members. (If only the church hierarchy had been so wise...sigh) This will end, however, with the progressive legitimization of gay "marriage." Since scouting is very parent based, they will no longer be allowed to hold their morally straight position in the face of adoptive, gay, "families" wishing to take part in their son's scouting activities.

This is awful! As the sister of two Eagle Scouts and two more in the making, I am saddened by this. My brothers and dad use the Boy Scout Headquarters a lot. It would be a big loss if the city revoked the lease!
