“We will appeal this verdict”

Pro-life pastor found guilty of violating Oakland’s abortion clinic ‘bubble law,’ faces imprisonment and hefty fines


The Rev. Walter Hoye, a pro-life Baptist pastor from Berkeley, faces up to two years in jail and $4000 in fines following his conviction on two counts of “unlawful approach” in violation of Oakland’s restrictive new ‘bubble law.’ His attorneys say they plan to appeal.

Hoye had initially been charged with four counts of violating the ordinance – two counts of “unlawful approach” and two counts of using “force, threat of force or physical obstruction” against ‘escorts’ at Family Planning Specialists Clinic in Oakland. The charges stemmed from two separate incidents – one on April 29, 2008 and one on May 13, 2008. Hoye was arrested on May 13 after a clinic staff member called police. He was carrying a 40-inch sign that read, "Jesus Loves You & Your Baby. Let Us Help You," and attempting to hand out pro-life literature.

A regular fixture at the clinic and an outspoken opponent of the “bubble law,” Hoye had challenged the constitutionality of the ordinance in a federal lawsuit pre-dating his arrest. He had become a top target for the clinic staff.

Alameda Superior Court Judge Stuart Hing dismissed one count of using “force, threat of force or physical obstruction” before the trial got under way on Jan. 5. After deliberating for about two days, the jury found Hoye guilty on Thursday, Jan. 15, of two counts of “unlawful approach,” but not guilty on the remaining “threat of force” count.

Hoye is scheduled to appear before Judge Hing on Feb. 19 for sentencing. Hoye said the judge ordered him to stay 100 yards away from the abortion clinic and have no contact with anyone associated with the clinic while he awaits sentencing. “It is my prayer that God’s name be glorified and the life of His Son Jesus Christ be revealed in me,” said Hoye.

Katie Short of Life Legal Defense Foundation and one of Hoye’s attorneys, expressed concerns over the judge’s instructions to the jury, a concern echoed by Hoye. “The jury members came back to ask to watch the videos again and asked the judge to define what constituted an ‘approach,”’ said Hoye. “There is a clear definition given by the U.S. Supreme Court in a case related to a similar law, the law the Oakland law is based on, but he wouldn’t give it to them.”

The videos to which Hoye refers were recorded outside the abortion clinic on May 13 and presented as evidence by the defense during Hoye’s trial. The tapes showed that clinic employees approached Hoye, not the other way around.

Short said that, on appeal, the constitutionality of the ordinance would be challenged. In addition, she said, the prosecution failed to meet its burden of proof.

Short also cited the questionable testimony of Family Planning Specialists clinic director Jackie Barbic, who told the jury she came downstairs with a tape measure and told Hoye to back away from patients, staff and escorts. Barbic testified that Hoye then came very close to her, stared at her and made her and two escorts feel very threatened and intimidated.

“When Barbic was on the stand, she told that story, saying that Walter walked up to within a couple of feet of her, and she had to back away from him,” said Short. “Her voice actually choked with emotion as she recounted how frightened she had been. She didn’t know that Walter had someone videotaping him that day. So on cross-examination, we showed her the videotape of the incident, showing her approaching Walter, and him not moving an inch toward her. Up until then, she had detailed everything that happened at the clinic that morning. But when she saw the tape that debunked her story, she said, ‘Oh! I just remembered that there was another time later in the day when I was downstairs that he approached me.’ We have videotape of Walter from when he arrived to when he left. What a smart person would have done was look at the videotape and say, ‘Oh man, you know, I could have sworn he got closer and had a threatening look on his face.’ Instead, she still insisted that he had threatened and intimidated her, but just later in the morning. And she gave us some cock and bull story that she had the tape measure to show the escorts the zone.”

Short said she is also troubled by the interpretation of what constitutes an “approach” under the law. “The ordinance prohibits approaching within eight feet of someone entering an abortion clinic, without their consent, for the purpose of... let’s call it ‘communication,”’ Short explained. “The clinic director and escorts took this to mean that Walter could not approach them without their consent, even though they were not entering the facility and he was not trying to communicate with them.”

Hoye, who has no previous criminal record, rejected a plea bargain offered by the district attorney before trial. The deal guaranteed no jail time if Hoye pleaded guilty to one count in exchange for dismissal of the other three. “The threat of four years in jail is a potent one, but my client is more interested in getting the truth out, both on the sidewalk and in the courtroom,” commented Mike Millen, another Life Legal Defense Foundation attorney working on Hoye’s case, when the offer was turned down.

“This is a miscarriage of justice and we will appeal this verdict,” said Allison Aranda, a staff counsel for Life Legal Defense Foundation, in a prepared statement following the verdict. “After speaking with several jurors after the verdict was read, it is clear that the court's failure and outright refusal to instruct the jury regarding the key elements of the crime led to the erroneous conviction of Rev. Hoye.”

The verdict came at the beginning of the holiday weekend honoring Martin Luther King Jr. -- an irony not lost on Rev. Hoye. “It's Martin Luther King Jr.'s birthday again and I can still hear his words in my heart: ‘The Negro cannot win as long as he is willing to sacrifice the lives of his children for comfort and safety.’”

Plan B for Antiabortion StreetAngels: Regarding Bubble Zone's near abortion mills, there exists a (MILLTHORN) Plan B. The MILLTHORN Plan B "kicks in" when activism near baby-killing centers is limited or restricted. Plan B removes the activist from the (entire if necessary) area of the mill. The demonstration (on the public sidewalk, naturally) moves to "other" business areas close by. It appears (according to mapquest) that this mill is not far from the (lovely) high-rent Lake Merritt area. Activists relocating to (non-abortion-related) areas with "large bloody posters", may draw curiosity (or even perhaps ire) from local restaurants and other businesses. It is more than likely that the activist/s may have to explain their presence in these peculiar areas. It could be explained that it is important (and rightfully so,) for everyone to see what abortion does to a baby. One could describe it as a mini- "SHOW THE TRUTH" exhibition. Explain that "Showing The Truth" is nothing more than providing a free public service. Explain too, that the City Fathers have moved the demonstration to this new location by restricting (through the creation of unconstitutional bubble zones) the activist/s ability to exercise one's free speech within an effective distance or range of the baby-killing facility. This puts "the ball" back in their court. Considering these awful economic times, this presence will no doubt become objectionable within the high rent areas. The tenants and business operators can then become the ones appealing to the City Fathers for relief--such as "GET RID OF THE BUBBLE ZONES". (Note: The operating hours of Plan B (in these BUSY BUSINISS AREAS) do not have to coincide with the those of the killing center. Just make sure the signs and be SEEN and appreciated.

God bless Rev. Hoye! He may not be a part of the true faith but he serves the Lord better than Catholic Bishops that hob-nob with pro-abortion politicos. He is willing to martyr himself (prison) for the innocents. The abortion lobby, with support from Obama/ Pelosi/ Reed will move forward aggressively. Support the Reverend whatever your faith!

Society cheers Charles Sullenberger, the pilot who saved lives, but the law vilifies a man who attempts to save babies.

A similar trial happened in Sacramento, CA. Similarly, the clinic workers took the oath and swore that a prolifer was using a bullhorn directly into the clinic and frightening all of the patients and staff with loud shouts. What the clinic was not aware of, was that they were being taped from across a busy street. The video revealed that the clinic workers were lying and perjuring. The case was dismissed and the prolifer was exhonerated. From what I understand in this circumstance, the jurors were nodding off during viewing of the video. Despite lying testimony which was disproved by the tape, the jurors convicted an innocent man. What can we expect? Our laws convict innocent children and our laws are not convicted those who dare to speak out in love and hope for these same children. America, wake up because soon the laws will turn against the elderly, the sick, the poor and you.

This case is quite similar to another one in Sacramento more than 10 years ago. (Our people in that, however, don't care to have that case discussed.) The surprising thing in these cases has been the level of collusion between the judicial authorities and the Killing Klinic Korporations. Ordinarily in California, panhandlers, dealers in illegal knock-off merchandise and even dealers in products which directly compete with stationary businesses, are not able to be ejected from their posts outside business doors on private property. Here we see the overriding influence of the population-control authorities, coming from the highest law in the land, the Ford, Rockefeller & Population Foundations, making the abortion industry the most protected economic sector, far more than any monopoly has ever been - some new term for this protectionism is needed. Nowhere in the world, not in Scandinavia or the Netherlands, are there more liberal abortion laws than in the U.S., and FOCA will further liberalize these. And worse yet than FOCA will be Universal Health Care, which will massively increase the abortion rate by instituting full taxpayer funding of abortion on demand, lowering the cost and heightening the profitability of abortions. I'm full of admiration for Reverend Hoye. I don't know anyone else who would be willing to do what he did. I hope that he will be exonerated completely but even then I have my doubts because many of us do not expect to receive justice from an American court of law.

They need to put the real criminals in jail not innocent people like this good pastor! The abortionist should be in jail for murder of babies! WHEN is the Christian community going to learn that the ONLY way to prevail in these show trials of prolifers is to get the word out to jurors that they can vote NOT GUILTY in the privacy of the jury room, no matter what the judge says. While it takes 12 jurors to convict, just one juror can hang the jury by voting "not guilty."

What does the editor have against the mention of Hitler? Why was my last post changed in context? Such power this editor has but they surely post a lot of heresies from those in objection to church teachings. The editor replies: It is ok to debate ideas, but it is not ok to use personal attacks or to accuse a specific individual of a moral failing. Garvan, ironically, we had one man in the jury pool who made an argument for jury nullification. He said he thought the law was unjust and therefore he would not be able to vote to convict no matter what the evidence was. Needless to say, he was excused from the jury "for cause," meaning the judge himself did it. We also had two people in the pool who identified themselves as Catholic. They, too, were excused for cause after they said they were pro-life and didn't think they could be unbiased. One of them remarked, "I probably should be out there doing what he [Walter] is doing." I wanted to kiss him on his way out the door. By contrast, we had not one but two women in the jury pool who had worked "clinic defense" before. What are the odds? We also had several people in the pool who expressed an animus against Christians in general.

Why would the judge make such an obvious "error" in not citing the law or allowing a review of the video? Isn't there some law against this sort of either incompetance or intentional perversion of justice? Are these judges who do such things not accountable for their misdeeds?

Mr. Editor thank you for your reply but I see that the politically correct essence has even effected our websites. It still does not make sense to me when heretical views are posted over and over and accepted by this website, but that is fine, I guess I have to play by your rules to keep my freedom of speech. JLS I ask that same question too regarding the misdeeds of these judges. This is a sad outcome and I hope that with perseverance, this pastor will end up winning. Aye these stories always saddened me, I'm sure it makes us all feel helpless. But it should never bring out fear in us, we should work together as one and never allow fear to control us. God bless this pastor, he has my full support, I just wish I knew what else we can do to help him. I will continue to pray for a better outcome.

Almond Milk, just because someone's views are different from yours, does not make them heretical views. We are all human beings and are all limited in our understanding of divine truth. Only God has absolute knowledge of divine truth. I find it troubling when people call people who do not share their opinions, heretics.

Dear Editor, Please explain the inconsistency of constantly allowing Mark from PA to impugn the motive of hate (a moral failing) to those who defend Church Teaching? Is Mark from PA being coddled to the detriment of fair posting? I understand debating heretical posts. Heretical posts are personal attacks against Christ and His True Church. Debates are necessary and they do help to educate. I do not understand hamstringing Almond Milk's Hitler comparison but allowing Mark from PA to hurl the motive of pure hate ( a moral failing) to anyone (including priests) who defend Church Teaching. Mark from PA is being allowed to post that truth is synonymous with hatred. Personally, I am in favor of Mark from PA's free speech and Almond Milk's free speech. I am not in favor of unfair and unbalanced hamstringing.

The guy who talked about nullification in front of the judge may have been dove-like, but he was decidedly not shrewd. When will "our" side learn to go into that jury room, sit and listen, and then just vote "not guilty"?

Almond Milk, I'm not so sure the editor was resorting to political correctness. The Hitler image tends to get overused, to where it has no impact. I think that what Obama is stepping up to as a leader is going to be unique, especially in the scale of things. When the western world confederates with the rest of it, which has not had the benefit of Christianity to such a huge degree, then like all confederations there will be the compromising of principals. It could even get to the point where the only principal left would be that of power. Obama looks up to the task ... is there anything in his history that suggests he would stick to morals over power if it came down to it? BTW, what are his morals? Or is he a pure power broker? Have we fallen into the clutches of pure power brokerage in our government? The morals of top leaders have eroded to where there are virtually none.

Since JLS has no clue what I was trying to post and I was denied that opportunity then he holds no water on commenting. I disagree with JLS because my comparison has not been over used because Obama is new in office and if given the opportunity to post it, people might actually understand what I was trying to convey. It is best to not make a judgment call on posts that I tried posting that did not get through, no one will ever know what I wanted to convey because I was not allowed. I will just leave this one alone, would of been better if JLS did so too for he has no clue what I was trying to convey since it did not appear on these posts. Nothing personal JLS.

In most cases it's more popular to be charitable to those posting error more often than allowing the faithful to try to convey something in which I thought was good. JLS as long as people run the church, Catholics websites, posts etc, it will never be perfect, even the faithful may be contributing to silencing the faithful at times. In these modern times speaking up for the unborn, or even trying to help a homosexual find healing can be politically Incorrect. We may be silenced in some parts but we can find other positive means to make a difference in someone's life. Like you once posted before "one person at a time sweet Jesus". I hope you are better today and to full recovery from food poisoning.

Yes, thankyou PA and Almond Milk, it put me down for a couple days. But the upshot is I didn't drink any coffee for those days, and upon recovery found many of my normal aches and pains gone; so I've kept off the coffee and feel better for it. Lesson: Out of discomfort can come blessing.

JLS try tea. Matcha green tea is good or any good herbal tea without caffeine. You are doing right by cutting back on coffee. If you continue coffee try organic and decaff.

Thanks Almond Milk. My toleration for tea, whether black, green (the high end good stuff included) is about two days. I used mostly organic food for decades, when it is available. The power of organically grown produce, such as once came out of my yard ... after some impressive soil amendments ... was astounding compared to anything I ever purchased at a store. It's more expensive but I'm convinced it saves a lot on doctor bills. It is difficult to grow oneself due to time, inclination and focus ... but inexpensive. I don't see why families wouldn't have their kids running such gardens. During WWII they called them "victory gardens"; old family photos of my turn of the century ancestors show them with yards full of homegrown veges ... and these are city folk I'm referring to. Organically raised animals and eggs are more difficult and require sufficient land ... way back, some friends raised a steer up to butchering size, had a butcher come out and do the job; his "cut" was half the meat, and what they got was the other half, individually wrapped and stored in the butcher's freezer. That steer put out about one third of its weight in table meat, about 300 pounds. At that time they paid maybe $40 for the calf, when hay cost $2 per 3-wire bale (125#). Then there is wild game, which if it has eaten the right stuff and been bagged in the right manner, is amazing, not just in flavor but in ... well my experience is minimal and with wild game birds ... doesn't take much to supercharge the energy level. The wild game tends to eat better than the domestic animals in many cases, especially the birds. In some areas game is costly mainly due to access whether private or public land, and then what with the rig to access the wilderness, the dogs, the training effort, the hardware for taking the creatures). I'm not a fisherman, but there is some additional fervor from that sector. How can anyone beat wild fish for "organic"?

JLS I wish I could have the talent to grow my own veggies as well. My mom has a good hand for that, she grows lots of good fruit trees. Thank you for your insightful post, I really enjoyed reading it. Get better now. Offer up your pain that you felt with that food poisoning for this wonderful pastor, may our Lord help him through this season of persecution, offering up one's own sufferings for another to receive graces and blessings is a beautiful gift. Since the subject of what heresy is and isn’t has come up, here is what the Catechism has to say. This is from the section on “Life in Christ” dealing with faith, paragraph 2089, “Heresy is the obstinate post-baptismal denial of some truth which must be believed with divine and catholic faith, or it is likewise an obstinate doubt concerning the same.” Also in that same paragraph is this about incredulity, “Incredulity is the neglect of revealed truth or the willful refusal to assent to it.” This in turn cites paragraph 817 on what wounds the unity of the Church, “The ruptures that wound the unity of Christ's Body - here we must distinguish heresy, apostasy, and schism - do not occur without human sin…” As to whether the truth of the Church is merely “someone’s view” or not, look to paragraph 79, “The Father's self-communication made through his Word in the Holy Spirit, remains present and active in the Church: "God, who spoke in the past, continues to converse with the Spouse of his beloved Son. And the Holy Spirit, through whom the living voice of the Gospel rings out in the Church - and through her in the world - leads believers to the full truth, and makes the Word of Christ dwell in them in all its richness." As to whether fallen man can know the truth see paragraph 38, which cites Pope Pius XII’s Humanae Generis, “… man stands in need of being enlightened by God's revelation, not only about those things that exceed his understanding, but also "about those religious and moral truths which of themselves are not beyond the grasp of human reason, so that even in the present condition of the human race, they can be known by all men with ease, with firm certainty and with no admixture of error".

Almond Milk, I'm happy you returned the topic to the needs of this pastor, who needs our prayers and sacrifices. He is sacrificing his life for unborn babies and for others, and we should follow his example in whatever ways we can muster. "Ordeals such as mine" are trifles. Even trying to optimize health is a trifle compared to the ordeal and Cross bearing being done by Pastor Walter Hoye; St Peter teaches us we can eat whatever we want ... I guess that includes junk food. Also, one of the NT letters (St James, or St Paul ?, or Acts ?) cautions us not to get too involved with dietary concerns. I think St Francis of Assisi emphasized this.

JLS St. Francis of Assisi what a wonderful holy saint. Lets ask for his intercession as well to help this pastor. There isn't a day that passes by that I don't think about what he is going through. I keep praying for him and all others in the pro life movement, Allyson and others who are always fighting the good fight. God bless them! We the faithful must stick together no matter what our differences are. JLS I recommend you watch Expelled by Ben Stiller. A really good documentary. Excellent. God bless you. All other watch Expelled by Ben. Pretty good the way it was put together can explain why we are having so many issues in our morals in today's society.

Reverend Hoye you are a true servant of the Lord... not afraid of repercussion and willing to stand for Christ all the way. May your steadfastness help those of us who face obvious future persecution much worse than this for the sake of our Redeemer and Lord. Stay strong and thanks for the example to all pastors who are afraid to present anything politican and controvesial to thir flocks. Because Christians have not been willing to speak as one... we will suffer more swiftly but we know how the story ends...... It is so regrettable that something like that happens in a so-called civilized, free society. As a Catholic involved with the Pro-Life cause, I find this conviction appalling. How is it possible that the law allows women to choose to killl their babies but doesn't allow a minister to choose where to stand on the sidewalk? That's something to think about. It is a grave injustice what happened to the Pastor. Okay, so I, for one, would like not just to speak about this extreme injustice against one who is trying to save the most innoncent of lives, I would like to know how best to help him in his case. What our Lord would do for him if we all fasted or taken on some sacrifice and prayed for the Pastor on the 18th or 19th or even both - or even give to his defense team.

The constitution is undermined daily. Child Protective Services has undermined 9 of the 10 amendments of the Bill of Rights, and I regret that at the time, I didn't have the backbone to stand up like this man for the heart and life of my country. As early as the declaration of independence, our founding fathers declared the self-evident God-given human rights of Life, Liberty, and the Pursuit of Happiness. Note that Life comes first, then Liberty, before Pursuit of Happiness. Our country, its constitution, and its original laws were founded on this principle. This was pointed out to me by my father, before he passed on, who served in WWII to preserve these rights. Let us not give up the fight, but press on all the more fervently in the face of oppression. Who knows whether or not we were raised up and placed here for such a time as this?
